What goes wrong — West Bengal and Kolkata specifics
A blank result on one portal is not a clean title
Records are split between wbregistration.gov.in and e-Nathikaran. Searching only one and finding nothing is routinely misread as a nil encumbrance when the deed simply sits on the other system.
Vested and ceiling-surplus land
West Bengal's land reform legislation vested substantial land in the state. Vested-land entries do not surface in a deed search but render a title unmarketable, and must be checked against the record of rights.
An EC only shows what was registered
Unregistered transactions, oral family arrangements, pending litigation, tax dues and unregistered agreements to sell do not appear on an EC. A clean EC is necessary but nowhere near sufficient — this is the most dangerous misunderstanding in property buying.
The search period matters more than most buyers realise
A 13-year EC is standard for bank purposes, but 30 years is the safer diligence horizon because it covers the limitation period for most adverse claims. Defects frequently sit further back than 13 years.
Pre-digitisation records may not appear online
Most states digitised registration records from the late 1990s or early 2000s. Anything earlier generally requires a physical search at the Sub-Registrar Office, and an online search that returns nil for those years is not evidence of a clean title.
Assessment moved to carpet area
In line with RERA, residential flats in West Bengal are assessed on carpet area rather than super built-up area. Valuations prepared on the older basis give the wrong duty figure.
