What goes wrong — Haryana and Faridabad specifics
The exemption is a notification, not a permanent rule
Haryana's blood-relative stamp duty exemption has been introduced, narrowed and restored at different times. Because it is notification-based rather than embedded in the Act, the position at the date of your registration is what governs — this is the single most important thing to confirm for a Haryana gift.
Urban and rural rates differ for non-relatives
A non-relative gift attracts 5% in urban areas and 3% in rural areas, so the property's classification changes the cost even before valuation.
Acceptance must occur during the donor's lifetime
Under Section 122 of the Transfer of Property Act, a gift is void unless the donee accepts it while the donor is alive and capable of giving. Deeds drafted without an express acceptance clause are a recurring cause of later challenge.
A gift deed is irrevocable once registered
Unlike a will, a registered gift deed cannot ordinarily be cancelled at will. Revocation is possible only on grounds agreed in the deed itself or under Section 126. Parents transferring property to children should consider whether a will, or a settlement deed retaining a life interest, better suits their intent.
Ancestral and coparcenary property carries additional constraints
Gifting undivided ancestral property without the consent of all coparceners exposes the transaction to challenge. This requires examination of the title chain before drafting, not after.
HUDA / HSVP plot conditions
Plots allotted by HUDA / HSVP carry allotment conditions that can restrict transfer, including by gift, until specified obligations are met. The allotment letter must be read before planning a transfer.
HSVP sector plots carry allotment conditions
Sector plots allotted by HSVP, formerly HUDA, carry conditions on construction and transfer that survive a sale. The Authority's own record must be substituted, which municipal mutation does not achieve.
Greater Faridabad (Neharpar) development status
The Neharpar belt developed rapidly with mixed licensing status. Licence and change-of-land-use permissions need checking directly rather than inferring approval from the fact of construction.
Aravalli and PLPA notified land
Land falling under Punjab Land Preservation Act notifications in the Aravalli belt carries construction restrictions that survive any transfer and have been the subject of repeated court orders.

Gift Deed FAQs — Faridabad
Is a gift deed to a blood relative exempt from stamp duty in Faridabad?
Haryana has exempted gifts of immovable property to blood relatives from stamp duty, with only the 1% registration fee applying subject to a ₹1,000 minimum. Because the exemption sits in notifications whose scope has changed over time, it must be confirmed against the current position before you rely on it.
What should I check before buying in Greater Faridabad or Neharpar?
Licence and change-of-land-use status, directly from the records rather than by inference. The belt developed quickly with mixed licensing, and construction on site is not evidence that the colony is lawfully licensed.
Can I build on Aravalli land near Faridabad?
Often not. Land notified under the Punjab Land Preservation Act carries construction restrictions that survive transfer and have been enforced through repeated court orders. Title can be clear while building is prohibited.
Which Sub-Registrar Office covers my Faridabad property?
Faridabad and Ballabgarh have their own offices, with Tigaon, Dhauj and Badkhal covering surrounding areas and Palwal, Hodal and Hathin the wider region. Jurisdiction follows the property's location.
