Gift Deed stamp duty & registration charges in Noida
Under the Indian Stamp Act, 1899 as applicable in Uttar Pradesh. Most Noida properties fall within NOIDA Authority / Greater Noida Authority limits.

How a gift deed is registered in Noida
- Confirm the donee is within the notified family list — son, daughter, father, mother, husband, wife, daughter-in-law, real brother, real sister, son-in-law, grandson or granddaughter.
- Check the applicable circle rate for the locality on IGRSUP.
- Obtain the title chain and an encumbrance search.
- Draft the gift deed with an accurate schedule and an express acceptance clause.
- Pay duty and generate the e-stamp through IGRSUP.
- Book the Sub-Registrar appointment and attend with both parties and two witnesses.
- Apply for dakhil kharij (mutation) with the municipal body or tehsil.

What goes wrong — Uttar Pradesh and Noida specifics
The ₹5,000 cap depends on a specific relative list
UP's notified list is generous — it includes daughter-in-law and son-in-law, which many states exclude — but a nephew, niece or cousin still falls outside it and attracts full conveyance rates on circle rate value.
The concession is recent, so older advice is wrong
The ₹5,000 cap was notified in January 2026. A great deal of guidance still online quotes the previous percentage-based rates for family gifts in UP.
Acceptance must occur during the donor's lifetime
Under Section 122 of the Transfer of Property Act, a gift is void unless the donee accepts it while the donor is alive and capable of giving. Deeds drafted without an express acceptance clause are a recurring cause of later challenge.
A gift deed is irrevocable once registered
Unlike a will, a registered gift deed cannot ordinarily be cancelled at will. Revocation is possible only on grounds agreed in the deed itself or under Section 126. Parents transferring property to children should consider whether a will, or a settlement deed retaining a life interest, better suits their intent.
Ancestral and coparcenary property carries additional constraints
Gifting undivided ancestral property without the consent of all coparceners exposes the transaction to challenge. This requires examination of the title chain before drafting, not after.
Dakhil kharij is separate from registration
Registration does not update revenue or municipal records. Until dakhil kharij completes, the donee is not the recorded owner, which obstructs later sale and loan.
Almost all Noida property is Authority leasehold
NOIDA and Greater Noida Authority land is allotted on long lease, not freehold. Every transfer requires the Authority's transfer memorandum and permission, and a registered deed without it leaves the buyer's position incomplete. This is the defining feature of Noida conveyancing.
Farmer compensation litigation over acquired land
Extensive land in Gautam Buddh Nagar was acquired from farmers, and compensation disputes have reached the courts repeatedly. Certain sectors and projects carry litigation history that no encumbrance search discloses.

Is Noida property freehold or leasehold?
Almost all of it is leasehold from the NOIDA or Greater Noida Authority. This is the single most important thing to understand here: a registered sale deed is not sufficient on its own, because the Authority's transfer memorandum and permission are required for the transfer to be complete against the Authority.
What is a transfer memorandum and do I need one?
It is the Authority's own record of the transfer. Without it the Authority continues to recognise the previous allottee, which obstructs any future sale, mortgage or lease-deed execution. We handle it alongside registration rather than treating it as an afterthought.
My project is stalled and the builder is in insolvency — what are my rights?
Where the builder is under insolvency proceedings, homebuyer claims run through the resolution process as financial creditors rather than through the builder-buyer agreement directly. This is a materially different route and needs advice specific to your project's stage.
