How a gift deed is registered in Varanasi

  1. Confirm the donee is within the notified family list — son, daughter, father, mother, husband, wife, daughter-in-law, real brother, real sister, son-in-law, grandson or granddaughter.
  2. Check the applicable circle rate for the locality on IGRSUP.
  3. Obtain the title chain and an encumbrance search.
  4. Draft the gift deed with an accurate schedule and an express acceptance clause.
  5. Pay duty and generate the e-stamp through IGRSUP.
  6. Book the Sub-Registrar appointment and attend with both parties and two witnesses.
  7. Apply for dakhil kharij (mutation) with the municipal body or tehsil.

What goes wrong — Uttar Pradesh and Varanasi specifics

The ₹5,000 cap depends on a specific relative list

UP's notified list is generous — it includes daughter-in-law and son-in-law, which many states exclude — but a nephew, niece or cousin still falls outside it and attracts full conveyance rates on circle rate value.

The concession is recent, so older advice is wrong

The ₹5,000 cap was notified in January 2026. A great deal of guidance still online quotes the previous percentage-based rates for family gifts in UP.

Acceptance must occur during the donor's lifetime

Under Section 122 of the Transfer of Property Act, a gift is void unless the donee accepts it while the donor is alive and capable of giving. Deeds drafted without an express acceptance clause are a recurring cause of later challenge.

A gift deed is irrevocable once registered

Unlike a will, a registered gift deed cannot ordinarily be cancelled at will. Revocation is possible only on grounds agreed in the deed itself or under Section 126. Parents transferring property to children should consider whether a will, or a settlement deed retaining a life interest, better suits their intent.

Ancestral and coparcenary property carries additional constraints

Gifting undivided ancestral property without the consent of all coparceners exposes the transaction to challenge. This requires examination of the title chain before drafting, not after.

Dakhil kharij is separate from registration

Registration does not update revenue or municipal records. Until dakhil kharij completes, the donee is not the recorded owner, which obstructs later sale and loan.

Temple trust and math-held property in the old city

Large parts of the ghats and old city are held by temple trusts, maths and endowments. Such property generally cannot be alienated, and long occupation does not create transferable title.
