Goa's Portuguese Civil Code provides an inventory proceeding for dividing an estate, which is a distinct route from a registered partition deed and is often the correct one after a death.

How a partition deed is registered in Goa

  1. Establish whether the property is ancestral / coparcenary or self-acquired and jointly held — the rules and who must consent differ.
  2. Trace the full title chain and identify every living co-sharer and legal heir, including daughters as coparceners.
  3. Obtain a surveyor's plan showing the proposed physical division and confirm each share is independently usable and accessible.
  4. Compute the value of each share being separated, since duty is charged on the separated shares rather than the whole.
  5. Draft the partition deed with a precise schedule for each share, then compute and pay duty via the Goa Registration Department.
  6. All co-sharers attend the Sub-Registrar Office together for execution and biometric capture.
  7. Apply for separate mutation of each divided share so every sharer holds an independent record.

What goes wrong — Goa and Goa specifics

Under the Portuguese Civil Code still applicable in Goa, division of a deceased person's estate among heirs runs through inventory proceedings before the court. Families who execute a partition deed instead sometimes find the division ineffective — this has no parallel elsewhere in India.

Communion of assets brings in spouses

Because spouses hold in communion under the Civil Code, a sharer's husband or wife may need to join the partition. Omitting them is a frequent ground of later challenge.

Mundkar and tenancy entries survive division

Form I & XIV entries pass to whichever sharer takes the affected portion, so the division should account for them rather than discovering them afterwards.

Every co-sharer must join, or the deed is open to challenge

A partition that omits a coparcener or legal heir — including one who is a minor, absent or estranged — is vulnerable to being reopened. Identifying the complete set of sharers is the substance of the work, not a formality.

Families frequently rely on an oral partition or an unregistered memorandum. These do not convey title in immovable property and will not be accepted by banks or buyers. A registered instrument is what makes the division effective against third parties.

Registration divides the property on paper. Until each sharer's portion is separately mutated in municipal or revenue records, none of them holds a clean, independently marketable title.

What is the stamp duty on a gift deed in Goa?

Under Article 32(a), a gift to a specified relative attracts a flat ₹5,000 stamp duty with a 0.5% registration fee. Gifts outside that list attract the conveyance slab, from 3.5% up to ₹50 lakh rising to 6% above ₹5 crore. Indicative figures compiled July 2026 — confirm before executing.

Who counts as a relative for Goa's ₹5,000 rate?

Goa's list is unusually broad: father, mother, brother, sister, husband, wife, son, daughter, grandson, granddaughter, brother-in-law, sister-in-law, nephew, niece, son-in-law and daughter-in-law. A gift to a nephew costs ₹5,000 in Goa where the same gift in Karnataka would attract 5% of guidance value.

Does my spouse need to sign the gift deed in Goa?

Very possibly. Under the Portuguese Civil Code still applicable in Goa, spouses commonly hold property in communion of assets, which means both must join the transfer. This has no parallel in the rest of India and is the most frequent cause of a later challenge to a Goan gift deed.
