Section 118 of the HP Tenancy and Land Reforms Act prohibits a non-agriculturist of Himachal Pradesh from acquiring land without prior permission from the State Government. This is the defining restriction on Himachal property, it catches nearly every outside buyer, and a transaction without permission is liable to vest in the state.

Can I buy property in Shimla if I am not from Himachal Pradesh?
Not without permission. Section 118 of the HP Tenancy and Land Reforms Act prohibits a non-agriculturist of Himachal from acquiring land without prior State Government sanction. This is the single most important thing an outside buyer must understand, and a transaction completed without permission is liable to vest in the state — a registered deed does not cure it.
Is there a way around Section 118?
Permission can be applied for under Section 118 and is granted for specified purposes, but it is a substantive government process rather than a formality. Arrangements structured to avoid the section — including lease and company structures — have been challenged, so this needs proper advice before any money moves.
Can I build or add a storey in Shimla?
