What goes wrong — West Bengal and Kolkata specifics
WB-HIRA was struck down — it no longer exists
The Supreme Court declared the West Bengal Housing Industry Regulation Act unconstitutional on 4 May 2021 in Forum for People's Collective Efforts v State of West Bengal, holding it repugnant to the central RERA Act. WBRERA rules followed on 27 July 2021, and complaints pending before HIRA stand transferred to RERA. A large amount of guidance still online treats HIRA as live — it is not.
Projects launched in the HIRA period need careful checking
Projects registered under HIRA between 2018 and 2021 occupy an awkward position. Establishing the registration status under the current WBRERA regime is the necessary first step in any Kolkata complaint.
Choose one forum — RERA, consumer court or NCLT — not all three
The same grievance can often go to RERA, a consumer commission, or the NCLT if the builder is insolvent. Filing in parallel weakens your position and can lead to dismissal. The right forum depends on what you actually want: refund, possession, compensation or interest.
An unregistered project narrows your options
RERA registration is mandatory for most projects above the threshold. If the project was never registered, the Authority can penalise the promoter, but your remedy for delay or refund may be better pursued elsewhere.
Insolvency changes everything
Once a developer enters insolvency, a moratorium under Section 14 of the IBC halts RERA proceedings, and homebuyers must file claims as financial creditors in the resolution process instead. Continuing before RERA at that point achieves nothing.
Delay interest accrues but must be claimed correctly
Interest for delayed possession runs at the rate prescribed under the state rules, typically linked to SBI's highest marginal cost of lending rate plus a margin. Claiming an incorrect rate or period is a common reason awards fall short of expectation.
Assessment moved to carpet area
In line with RERA, residential flats in West Bengal are assessed on carpet area rather than super built-up area. Valuations prepared on the older basis give the wrong duty figure.

Records are held on wbregistration.gov.in and, for many computer-recorded deeds since 2000, on e-Nathikaran. A blank result on one portal is not proof the deed does not exist — both must be searched before you rely on a clean title.

I cannot find my deed on the WB Registration portal — what now?
Try e-Nathikaran at cs.enathikaran.gov.in, which holds West Bengal's computer-recorded deeds since 2000. Records are split across the two portals, and a blank result on one does not mean the deed is missing. We search both as part of verification.
