Goa is the significant exception in India: succession is governed by the Portuguese Civil Code, which imposes forced heirship. A Goan testator cannot freely dispose of the whole estate, so the drafting exercise here is fundamentally different.

How a will drafting is registered in Goa

  1. Establish exactly what the testator owns solely, jointly, and as coparcener — this determines what can validly be willed.
  2. Identify beneficiaries and confirm no intended witness is also a beneficiary.
  3. Draft the will with a clear asset schedule, residuary clause, executor appointment and express revocation of earlier wills.
  4. Execute the will in the presence of two witnesses who attest in the testator's presence.
  5. Where the testator is elderly or unwell, obtain a contemporaneous medical fitness certificate to pre-empt capacity challenges.
  6. Register the will at the Sub-Registrar Office — optional, but it materially strengthens the evidentiary position.
  7. Compute the legitime — the reserved share that must pass to forced heirs under the Civil Code — before deciding what the will can freely dispose of.

Forced heirship limits what a Goan will can do

Under the Portuguese Civil Code still applicable in Goa, a portion of the estate — the legitime — is reserved for forced heirs and cannot be willed away. A will drafted on the assumption of free testamentary disposition, as applies in the rest of India, will fail to the extent it trespasses on the reserved share. This is the single most important difference in Goan estate planning.

Communion of assets determines what the testator owns

Spouses hold in communion under the Civil Code, so the testator may only own half of what appears to be theirs. Establishing the marital property regime precedes any drafting.

Inventory proceedings follow death

Division of a Goan estate typically runs through court inventory proceedings rather than a simple mutation, which is a materially different and slower route than elsewhere in India.

A witness who is also a beneficiary can lose their bequest

Under the Indian Succession Act, a bequest to a person who attests the will is void, though the will itself survives. Families routinely use a son or daughter as witness and unintentionally invalidate that person's inheritance.

A will cannot dispose of what the testator does not solely own

Undivided coparcenary interest, jointly held property and property held with survivorship rights cannot always be willed freely. A will drafted without establishing the nature of ownership creates disputes rather than preventing them.

Registration is optional but evidentially valuable

A will need not be registered to be valid. But an unregistered will is far easier to challenge on grounds of forgery or undue influence, and registration creates a contemporaneous official record of execution.

What is the stamp duty on a gift deed in Goa?

Under Article 32(a), a gift to a specified relative attracts a flat ₹5,000 stamp duty with a 0.5% registration fee. Gifts outside that list attract the conveyance slab, from 3.5% up to ₹50 lakh rising to 6% above ₹5 crore. Indicative figures compiled July 2026 — confirm before executing.

Who counts as a relative for Goa's ₹5,000 rate?

Goa's list is unusually broad: father, mother, brother, sister, husband, wife, son, daughter, grandson, granddaughter, brother-in-law, sister-in-law, nephew, niece, son-in-law and daughter-in-law. A gift to a nephew costs ₹5,000 in Goa where the same gift in Karnataka would attract 5% of guidance value.

Does my spouse need to sign the gift deed in Goa?
