What goes wrong — Assam and Guwahati specifics
Probate was never mandatory in Assam
Section 213 applied only to the former presidency towns of Calcutta, Bombay and Madras. It was omitted entirely by the Repealing and Amending Act, 2025, so probate is now optional across India.
A beneficiary who witnesses the will loses their bequest
A bequest to a person who attests the will is void, though the will survives. Families routinely use a child as witness and unintentionally void that inheritance.

Assam designates protected tribal belts and blocks where land transfer to those outside the protected classes is restricted. Transactions breaching the restriction can be set aside.

Assam distinguishes myadi (periodic, heritable and transferable) patta from eksonia (annual) and other tenures with restricted transferability. Establishing which class applies is a threshold question, and land marketed without reference to it is a common problem.

What is myadi patta and why does it matter in Guwahati?
Assam distinguishes several land tenures. Myadi patta is periodic, heritable and transferable; eksonia and certain other tenures carry restrictions or are annual. Establishing which class your land falls under is a threshold question, because some tenures cannot be freely sold at all — and land is frequently marketed without reference to it.
Can I build on Guwahati's hills?
