Probate was never mandatory in Punjab

Section 213 applied only to the former presidency towns of Calcutta, Bombay and Madras. It was omitted entirely by the Repealing and Amending Act, 2025, so probate is now optional across India.

A beneficiary who witnesses the will loses their bequest

A bequest to a person who attests the will is void, though the will survives. Families routinely use a child as witness and unintentionally void that inheritance.

The exemption is notification-based, not statutory

Punjab exempts gifts to blood relatives from stamp duty, but the exemption and its relative list have been varied by notification over time. The position at the date of registration governs, and this is the single most important thing to confirm for a Punjab gift.
