A will attracts no stamp duty and registration is optional. Probate was never mandatory in Jharkhand, and following the 2025 omission of Section 213 it is not mandatory anywhere in India.

How a will drafting is registered in Ranchi

  1. Establish exactly what the testator owns solely, jointly and as coparcener.

  3. Draft the will with an asset schedule, executor appointment and express revocation of earlier wills.
  4. Execute before two witnesses who attest in the testator's presence.
  5. Obtain a medical fitness certificate where the testator is elderly or unwell.
  6. Register the will at the Sub-Registrar Office — optional but evidentially valuable.
  7. Consider probate only where the estate is large or a challenge is anticipated.

Probate was never mandatory in Jharkhand

Section 213 applied only to the former presidency towns of Calcutta, Bombay and Madras. It was omitted entirely by the Repealing and Amending Act, 2025, so probate is now optional across India.

A beneficiary who witnesses the will loses their bequest

A bequest to a person who attests the will is void, though the will survives. Families routinely use a child as witness and unintentionally void that inheritance.

Can I buy land from a tribal owner in Ranchi?

Generally not. The Chotanagpur Tenancy Act prohibits transfer of tribal land to non-tribals across most of the Ranchi region, and a breaching transaction is void with the land liable to restoration to the original holder.
